New Jersey’s ban on certain assault-style firearms and magazines holding more than 10 rounds will remain in effect while the state seeks review from the U.S. Supreme Court.
The Third U.S. Circuit Court of Appeals on Tuesday temporarily blocked its July 17 ruling that found the restrictions unconstitutional, preventing the decision from taking effect while the appeal moves forward.
The appeals court had ruled 10-5 that New Jersey could not prohibit commonly owned semiautomatic rifles, including AR-15-style firearms, or large-capacity magazines used for lawful purposes. The ruling marked the first time a federal appeals court struck down a state assault weapons ban on Second Amendment grounds.
Attorney General Jennifer Davenport welcomed the stay, saying it provides stability and allows the state’s 36-year-old law to remain in place while the Supreme Court considers whether to hear the case.
New Jersey has restricted certain assault firearms since 1990 and lowered the maximum legal magazine capacity from 15 rounds to 10 in 2018. The Supreme Court is also expected to consider challenges involving similar restrictions in Illinois and Connecticut.
