A bill that would provide support for employees grieving the loss of a child or facing the emotional challenges as a result of an unsuccessful adoption or fertility treatments cleared the Assembly. Bill A3505, sponsored by Assemblymembers Shanique Speight, William B. Sampson, and Garnet R. Hall would allow employees to take bereavement leave under specific circumstances. This bill would apply to employees who are eligible for leave under the Family Leave Act.
“This legislation is a vital step forward in recognizing the profound grief that accompanies the loss of a child, or the challenges associated with building a family,” said Assemblywoman Speight (D-Essex, Hudson). “A3505 ensures that employees have the necessary time to heal without the added fear of losing their job security.”
Under this legislation, individuals would be able to take family leave to grieve the loss of a child due to death, miscarriage, stillbirth, or termination of a pregnancy for medical reasons.
Additionally, the bill recognizes the emotional toll of family-building efforts by accommodating leave for unsuccessful adoption plans and unsuccessful fertility treatments.
