The Jackson Jewish Community Council (JJCC) has issued a community notice warning residents and prospective homebuyers that basement rentals in Jackson Township remain strictly illegal, amid reports that some realtors have been misleading buyers about the law.
According to the JJCC’s statement, certain realtors have falsely suggested that basement rentals could soon become legal, encouraging buyers to purchase homes at inflated prices under the mistaken belief that they will be able to generate rental income from basement units. The council called these claims “false and deceptive,” emphasizing that there are no current efforts or plans to change the law prohibiting basement rentals.
“Allowing basement rentals is broadly viewed as a form of overdevelopment and is strongly opposed,” the JJCC wrote. The group warned that any homeowner found renting out a basement could face legal action and enforcement, and stressed that neither askonim nor elected officials will be able to intervene on behalf of violators.
The JJCC urged all prospective homeowners to verify facts before making housing decisions and to ensure they can afford their homes without relying on illegal rental income. The notice concluded by stating that it was being issued to “protect the community from misinformation” and prevent costly and avoidable mistakes.
The reminder comes amid growing demand for housing in Jackson and surrounding areas, where zoning and rental regulations remain a sensitive topic within the broader Orthodox community.
